Austin and San Marcos Bankruptcy Attorney

Texas Chapter 7 and Chapter 13 Lawyer

If you face unmanageable debt and want to put an end to the harassing phone calls and letters or stop a foreclosure or repossession proceeding, a personal bankruptcy filing can help you get a fresh start. Filing for protection under Chapter 7 or Chapter 13 will put an automatic stay in place, prohibiting creditors from calling, writing or taking any other legal action to collect the debt. The bankruptcy laws have changed, though. You want an experienced and knowledgeable attorney to help you through the process.

At the office of Marilyn G. Miller, Attorney at Law, we bring more than 25 years of legal experience to people throughout the Hill Country in Central Texas who need bankruptcy counsel. Attorney Marilyn G. Miller is board-certified in consumer bankruptcy by the Texas Board of Legal Specialization. She also clerked for a bankruptcy judge before opening her own practice.

To schedule an appointment with an experienced bankruptcy lawyer, contact our office or call us in Dripping Springs at 512-894-0319.

Texas Chapter 7 Attorney

We handle all matters related to a Chapter 7 or Chapter 13 bankruptcy filing, helping you prepare and file all documentation necessary to complete the process, and acting as your advocate in meetings or hearings with creditors, the bankruptcy court or the trustee.

When you first come to us to discuss your personal bankruptcy options, we will apply the means test established under the revisions to the bankruptcy laws to see if you qualify to permanently discharge debts under Chapter 7. We will carefully explain which debts can be discharged as well as which assets you can protect, so you get the benefits you expected from a filing.

Chapter 13 Dripping Springs Bankruptcy Lawyer

If you are not eligible to file under Chapter 7 (normally because you have a job), or you want to repay your creditors, we will help you file for reorganization of your debt under Chapter 13. Under Chapter 13, you can set up new payment plans with your creditors, agreeing to settle all debts over a three- to five-year period. We will help you put together a reorganization plan and will review any proposed repayment plans to ensure they are within your means.

We do not handle personal bankruptcy filings on an emergency basis and do not represent businesses in Chapter 11 reorganization filings. However, we have an extensive network of other bankruptcy lawyers in the area and can refer you to someone who will help you get the debt relief you need.

We often handle bankruptcy petitions for seniors who face financial problems because of medical expenses or the costs for nursing home or long-term care for a loved one. We can help you plan to avoid these types of problems. See our elder law page to learn more.
